Of course, another type of “surrogacy” on the Internet is when the husband and the “third party” become pregnant through direct sexual intercourse or artificial insemination, and the child is returned to the couple to raise. Although the law does not explicitly prohibit surrogacy, two administrative regulations of China’s Ministry of Health, the Administrative Measures on Human Assisted Reproductive Technology and the Administrative Measures on Human Sperm Bank, both prohibit surrogacy and the sale of sperm, eggs and fertilized eggs. However, the two regulations are to a large extent only for medical institutions and medical personnel, and are not legally binding and cannot regulate the surrogacy market. Therefore, there are still “underground” operations. Now, in the face of such a chaotic situation, many domestic scholars agree that surrogacy should be legislated. In the long run, the legalization of surrogacy in China is an inevitable trend. At present, the main reason why the authorities do not allow surrogacy is that the relevant laws are not sound and some problems that may arise in the process of surrogacy cannot be solved. But he also stressed that even if surrogacy is legalized, it is necessary to prevent the emergence of commercial surrogacy. Of course, it is appropriate to give surrogate mothers proper compensation.
