What is the approach to managing the use of drugs for over-indications?

The management of the use of drugs for over-indications specifically refers to the second paragraph of Article 29 of the Law of the People’s Republic of China on Physicians, that is, the premise of informed consent of the patient has been reached, and in the absence of effective or better treatments under the current conditions of medical technology, it is possible to adopt the use of medicines that are not explicitly described in the drug manual to implement treatment (but still need to have evidence-based medical evidence). Specifically, the following three conditions must be met for the use of drugs beyond the instructions: 1. There is no effective treatment available and other special circumstances. 2. The patient’s informed consent has been reached before treatment. 3. The drug has evidence of evidence-based medicine. Therefore, within a reasonable range, the use of drugs beyond the specification has a legal protection.
