According to Article 10 of Chapter 2 of the Regulations on Human Organ Transplantation, which came into force on May 1, 2007, the recipients of living organs are limited to the spouse, immediate blood relatives or collateral blood relatives within three generations of the living organ donor, or persons who have evidence of a kinship relationship with the living organ donor due to support. Otherwise, it is illegal and must be punished according to law. The “cross-kidney exchange” incident once sparked the controversy of “life or regulations first”. The two families from Hunan were decided by the ethics committee of a hospital in Guangzhou that they did not meet the legal requirements and suspended the operation, and then successfully “crossed kidneys” in a hospital in Hainan. While the public opinion is widely in favor of regulations to make way for life, some experts believe that if “kinship” is arbitrarily determined, it may provide an opportunity for organ trading.
