Is it abuse or natural justice for parents to beat their children?

In recent years, child abuse cases have occurred frequently throughout China. Abused children, in addition to physical injuries, are accompanied by long-term growth shadows. How can we protect the legal rights of children and keep them away from violence and grow up healthy? First of all, let’s understand what is the crime of abuse. 1.What is the crime of abuse? According to Article 260 of the Criminal Law, it is the act of physically and mentally destroying and persecuting a family member living together by beating, tying up, freezing and starving, restricting freedom, abusing personality, not giving medical treatment or forcing to do excessive work, etc., with bad circumstances. The crime of abuse is a crime that occurs between family members, and there is a certain kinship and support relationship between the perpetrator and the victim, such as husband and wife, father and son, brothers and sisters, etc.. Abuse of non-family members does not constitute the crime of abuse (but if the abuse directly causes serious consequences to the victim, the social harm is serious and constitutes other crimes, it can be punished as other crimes). 2.What are the common acts of child abuse? Child abuse generally includes four types of situations: physical abuse, mental abuse, sexual abuse and neglect. (1) Physical abuse: is non-accidental physical injury caused by a caregiver to a child that results in death, physical disfigurement, impairment or loss of bodily function, or placing the child in a situation where such injury is likely to occur. (2) Mental abuse: includes verbal abuse, intimidation, threats, contempt, rejection of the child, or persistent unconscionable differential treatment of the child; indifference to the child’s well-being that results or is likely to result in physical development, intellectual, emotional, psychological, behavioral, and social development (3) Sexual abuse: Any sexual contact with a child that occurs when the adult uses the child as a sexual object of stimulation. (4) Neglect: Neglect of the basic needs of the child due to ignorance, inadvertence or intentional inattention, resulting in improper care, so that the child is physically and mentally harmed or likely to be harmed. 3.What kind of punishment will be given for child abuse? (1) Parental or family member abuse of a child Conviction: abuse by a family member, the conviction is for the crime of abuse; Sentence: The person who commits this crime shall be sentenced to imprisonment for a term not exceeding two years, detention or control. If you commit this crime and cause serious injury or death to the victim, you shall be sentenced to imprisonment for a term of not less than two years and not more than seven years. (2) school, kindergarten teachers abuse of children Conviction: because the “Protection of Minors Law”, “Criminal Law” and other non-family members abuse of children, there is no clear provisions, mostly guiding provisions, in this case, randomly beat others, the circumstances are bad, generally convicted and punished for the crime of provocation; sentencing, according to the “Criminal Law of the People’s Republic of China, Article 293, randomly beat others, the The aggravating circumstances, sentenced to less than five years of fixed-term imprisonment, detention or control. 4.How to prevent the recurrence of child abuse? (1) Parents: First of all, we need to change the traditional concept of “no beating, no weapon”, such as beating the palm, spanking, punishing standing, etc., but few people consider the serious consequences, should change the concept of education, in a scientific and reasonable way to give children a clear psychological sunny day. Secondly, parents should also communicate with their own children in time to understand in order to better discover their children’s ideas. (2) Law: Consider the establishment of a separate “child abuse crime”, and change from private prosecution to public prosecution, while taking measures to lower the threshold of incrimination and increase the penalty. (3) National institutions: In order to carry out in-depth and systematic treatment of child abuse, it is necessary for the state to take the lead and set up relevant professional departments to specialize in this work. (4) Other members of the family: If abused by parents or family members, children are usually afraid to inform others due to multiple reasons such as smallness or fear, as other members of the family or neighbors, etc. need to lend a helping hand and persuade or call the police to solve the problem. Conclusion: Children are the hope of the society and the future pillar of the country, and the healthy growth of children directly affects the future development of the country. How to protect the healthy growth of children is an issue that every society and every country should pay great attention to. The education model of corporal punishment in China since several years ago is obviously anachronistic and should be eliminated, and the phenomenon of child abuse should be eliminated. In the face of this difficulty, the law should be more perfect, and society, schools and families should also take some responsibility to create a good, violence-free environment for children’s growth.
